Mino' service
Mino is a music and audiovisual content platform operated through our website https://Mino.live/ or another website designated by Mino (hereinafter the "Website") and through applications designated by Mino (together with the Website hereinafter the "Platforms"), by paid subscription, or by free access to access concerts, festivals and music documentaries (hereinafter "Content") on your various web devices.

In the event of any conflict between the Special Terms and Conditions and the General Terms and Conditions, the Special Terms and Conditions shall prevail. The General Terms and Conditions and the Special Terms and Conditions together constitute the applicable agreement between the User and Mino.
The User agrees to use Mino's Services and Content for personal use only and in no case for commercial purposes. It is strictly prohibited to use the Mino Services in establishments open to the public.
You agree not to create an account on behalf of another person or any group or entity or to use the account information of another person. You agree not to use the Services and Content in any manner that could damage, disable, overburden, or impair the Services or Content. You agree not to make any copies or other reproductions of the Content, including, without limitation, sound recordings, and not to use or assist any other person in using any data mining, robots, scraping, or similar data gathering or extraction methods. You agree not to share your Mino account with any third party or provide your username and password to other Users.
Territory
The Service may be used worldwide, although the domicile of the service provider is deemed to be Spain and the applicable law is Spanish law. Subject to applicable laws and copyrights as well as certain technological features, the Service may be modified according to certain international locations. The Content and the manner in which we deliver digital Content to you will vary over time and by location. Mino will use technologies to verify your geographic location, so you will not be able to use any technology or technique to hide or change your location. It should also be noted that the quality of the Service may be lower when used outside of Spain.
Content
The User will have access to content such as audio and audio-visual recordings, playlists, interviews, video clips, movies, documentaries, album covers, subtitles and translations, as well as any other intellectual property works (hereinafter the "Content") on the Mino Platforms and/or Website, once a Subscription has been purchased, and upon acceptance of the Terms of Use. The Service and its Content may be altered, replaced, modified or updated in the future. Changes, modifications or updates to the content of the Service that do not change the general character of the Service and changes to the appearance of the Platforms shall not be considered a modification of the Offered Service.
Supported Devices
In order to use the Service, the User must have the necessary and approved systems, connections and equipment. System requirements are specified by Mino on the Website or by other means. However, compliance with the system requirements does not guarantee that the User will be able to use the Service. Use of the Service may require installation by the User of third party software. Mino will provide information on the Website and by other means regarding third party software that may be used, but under no circumstances will Mino be responsible for such third party software.
The Service requires the User to have access to the necessary Internet connection. The User is responsible for all charges associated with such connection, including data traffic charges, regardless of the area of the Territory (see, above, clause 2.1) in which the User uses the Service. The requirements relating to the minimum download speed required to use the Service can be consulted on the Website and can also be consulted by other means.
Only the types of equipment listed on the Website or otherwise communicated by Mino may be used and registered for the Service. Mino shall have the right to determine from time to time, in its sole discretion, which equipment is to be considered approved. Mino assumes no responsibility for the operation of any approved equipment or its compatibility with the Service.
The User shall be entitled to use and register the Service on computers, cell phones, tablets or other approved devices, with no limit on the number of devices. Registered and approved devices can be modified in the User's account. Mino may implement rules on how often the User may change registered and approved devices. Information regarding such rules shall be communicated to the User in accordance with clause fourteen. Unless otherwise notified in writing by Mino, only ONE (1) simultaneous registered and approved device may be used to view content at the same time.
Mino is not responsible for the User's failure to use the Service or limited access to the Service due to Internet overload or due to failures or problems related to computers or other devices, networks, electronic devices or communication systems.
Subscription
For Mino's services and content, we will charge a monthly subscription fee. Mino will specifically inform all Users of the terms and conditions at the time of registration and subscription to our services.
On the other hand, for the more proactive Users, Mino may also offer the possibility to pay in advance for the subscription of several installments for a specific period of time (hereinafter referred to as "Time-Based Subscription"). Of course, in this case, the subscription will automatically cease at the end of the fixed period, unless you make a new payment, which may be a monthly fee or, again, a Term Subscription.
Mino may offer Users the possibility to try the Service free of charge (hereinafter referred to as a "Free Subscription"). The duration of the Free Subscription will be specified at the time of subscription and the purpose is to offer Mino's services to new Users as well as former Users to test the Service again. Mino determines this free subscription at its sole discretion and discretion in order to avoid abuse of the free subscription, and Mino reserves the right to cancel and/or block your account if the User does not meet the eligibility requirements.
Mino and its third party partners may also offer the User free use of the Service for a certain period of time, for example by means of vouchers (hereinafter a "Free Subscription"). For this free subscription, the User has the right to terminate the Agreement at any time during the free period.
Please also note that in order to obtain the Free Subscription you must not have been a Mino User before, have already had another Free Subscription or have obtained any form of voucher or discount, and/or marketing offer in the last twenty-four (24) months.
Mino does not offer download services or offline content on its platform, all content will be streamed. Currently Mino does not offer promotional or advertising content within its platform, however Mino has the right to offer it at any time by informing the User in advance.
If the User has not terminated the Agreement during the free Subscription period, the free Subscription will automatically, and without prior notice to the User, be converted into a Subscription. Consequently, if the User does not wish to become a paying User, the User must terminate the Agreement during the free Subscription period, in accordance with the terms of the Agreement.
If the User has purchased a Subscription through a third party and such third party offers a trial period, the terms and conditions for the trial period are determined by the third party and not by Mino.
The various types of subscriptions and their specific designations may be changed by Mino at any time without notice (unless otherwise required by applicable law). Any changes to the various subscription types will only apply as of the next subscription period. In the event that the User does not agree to such changes, the User may cancel the subscription in accordance with the provisions of the seventh clause.
Username and Password
The User who has created the Mino account and on whose Payment Method the fees are charged (the "Account Holder") is responsible for the activity that takes place on the Mino platform. In order for Mino to maintain control over users and prevent anyone else from accessing a User's account, the User must have control over his or her accounts and passwords in order for the service to be properly provided to the User. In addition, Mino may use authentication mechanisms so that a User does not share his or her account and password with other Users. Thus, the User is responsible for updating his/her data and providing them individually and truthfully to Mino.
From Mino, we may block or terminate your account to protect the contents of Mino or our Users, in cases of fraudulent activities, such as account sharing or identity theft.
Periodo de Suscripción, cancelaciones y reembolso
La suscripción de Mino tiene un plazo de UN (1) mes y se renueva automáticamente por períodos consecutivos de un mes hasta que el Usuario o Mino rescinda el Acuerdo conforme a estas condiciones de uso. El periodo de suscripción gratuita será de SEIS (6) meses.
By entering into this Agreement, the User agrees to the immediate provision of the Service and the immediate availability of the content to the User. Without prejudice to the provisions of the fifth clause and in accordance with Royal Legislative Decree 1/2007 of November 16, 2007, the Mino User accepts that he/she does not have the right to cancel the subscription once it has been contracted. In any event, Mino will not refund any subscription paid during the relevant period and the User is entitled to continue using the Service until the end of that period.
Where Mino users have a free subscription, they have the right to cancel the subscription at any time during the free term, without having to pay the paid subscription. In the event that the user has not cancelled the free subscription during the free term, this subscription will be automatically converted, without prior notice to the User, into a Paid Subscription.
Modifications
Mino has the right to modify the subscription plans, rates, terms, conditions and content as it sees fit. In any case, Mino will not be able to modify all of these, before 30 days following our notification. In the event that the User does not accept the modified changes, the User may terminate prior to the date of modification.
In the event that the User does not terminate the Agreement prior to the notified changes taking effect, the User shall be deemed to accept such changes. In addition, where the User has made payments in respect of a period after such changes come into effect, the User shall be bound by the previous Agreement for the remainder of such period. In any event, any changes that are more advantageous to the User shall apply immediately without right of termination in favor of the User and Mino is not obligated to notify the User of such changes.
Notwithstanding the foregoing, if the User has purchased a subscription to Mino through a third party partner, the User's rights are governed by the terms and conditions of that agreement.
Rules of Use
The User agrees to use the service in accordance with these terms and conditions. Under no circumstances may the User act in a way that may cause damage to Mino and/or the service and/or the platforms and if applicable may never prevent it from ceasing to function as a result of hacking, overloading or damaging Mino. In addition, the User may not interfere with or invade another User's service.
Mino Users must complete the personal and payment data fields in order to use the platform and website. Likewise, the User of free subscriptions is also obliged to provide his/her personal and payment data, although Mino will not charge for this type of Subscription.
Likewise, it is forbidden to attempt to gain unauthorized access to computer systems, networks, content or information related to Mino, its platform, content or the service offered. Failure to comply with the above will be considered a violation of these terms and conditions and will result in immediate termination of the Agreement and a possible claim to the appropriate legal effects.
Payment methods
Users of free subscriptions are also required to provide their payment details, although Mino will not charge for this type of subscription. To subscribe to Mino's services you must indicate one or more payment methods. In the event that the initial payment method does not work or is rejected, we will be able to charge you the corresponding fee in the second payment method you indicated, and Mino will charge you accordingly.
When Mino is unable to collect the corresponding amount we will contact the User, and in any case the User will remain responsible for the unpaid amount. This situation may be caused by expiration of the User's payment method or for reasons that correspond to your bank, and if Mino does not collect the amount and the User does not cancel the subscription or does not pay the amount by another payment method, Mino will be authorized to suspend access to the service until it has not collected the amount due.
Certain payment method issuers may charge you amounts for foreign currency transactions or other related fees, as well as taxes that may vary depending on your territory. In no event will Mino be responsible for such items, and for this reason we recommend that you consult your Payment Method service provider in advance.
According to any modification you make on the payment method, you authorize Mino to collect the relevant payments. Likewise, the User may modify the payment methods at any time.
Billing
The price of Mino subscriptions may include VAT, or any other applicable taxes. Where applicable, such taxes will be collected by the party with whom you transact for the service. Mino does not guarantee a specific content subscription availability or a minimum amount of subscription content available in any subscription. Additional terms applicable to a subscription (such as applicable cancellation and refund policies) will be indicated on the information pages for that subscription on the primary Service website for your location.
Intellectual Property and Reservation of Rights.
Under these terms and conditions, Mino grants the User a license to view audiovisual content on an individual, exclusive, non-transferable basis, limited to the content of the Service. Mino or its licensors shall own all content offered to the User. All content is protected by intellectual property and copyright, as well as by trademark rights and any other legislation applicable to the specific case. This document is in no way considered as a transfer of ownership of content to the user or the transfer of any intellectual property rights over the contents of Mino. For all of the above, Mino reserves the rights to all of its contents.
Liability and Claims
For any dispute that may arise in connection with the interpretation or execution of this Agreement, Spanish law shall apply. If any provision of these terms and conditions is declared invalid, illegal or ineffective, the validity, legality and effectiveness of the remaining provisions shall remain in full force and effect.
General Provisions
Mino may provide links to other websites of third party partners. Mino has no control over, and assumes no responsibility for, such links or the content of such websites. Your use of such websites is at your own risk.
